How Texas Law Defines Drug-Related Intoxication
Drug DUI is a common search term, but Texas law generally calls the offense Driving While Intoxicated. Under Texas Penal Code Section 49.04, a person commits this offense by operating a motor vehicle in a public place while intoxicated.
Texas Penal Code Section 49.01 defines intoxication to include not having the normal use of mental or physical faculties because of alcohol, a controlled substance, a drug, a dangerous drug, another substance, or a combination of substances. The definition also covers an alcohol concentration of 0.08 or more, but that numerical standard doesn’t describe every drug-based allegation.
Unlike many alcohol cases, a drug-related charge may depend heavily on officer observations and the interpretation of biological testing. The prosecution may rely on driving behavior, statements, field sobriety testing, blood evidence, or several forms of evidence together. Each must be considered in context. The detected presence of a substance alone doesn’t prove impairment.

Lawful prescription or medically authorized use doesn’t automatically defeat a DWI allegation, but it also doesn’t relieve the prosecution of its burden. The medication, dosage, instructions, timing, reported concentration, and observed conduct may all affect the analysis.
A DWI Arrest Can Trigger Two Separate Proceedings
A Texas DWI arrest may lead to both a criminal prosecution and an administrative license process involving driving privileges. These proceedings may follow different procedures and deadlines, making prompt review of arrest paperwork and notices important.
Potential consequences depend on the charged offense, prior convictions, alleged injuries, whether a child passenger was involved, and other facts. Under Texas Penal Code Section 49.09, prior convictions can increase the classification of a later offense and affect minimum confinement requirements. A crash involving serious bodily injury or death may lead to intoxication assault or intoxication manslaughter allegations rather than a standard DWI charge.
